Infralex partner Artem Kukin has commented to the newspaper “KommersantЪ” on the case related to the arbitration award. The arbitration decided upon a debt of the bankrupt company before the creditor but the other creditor put this debt in doubt. The Russian Higher Arbitrazh (Commercial) Court offered to the creditor in whose favor was the arbitration award has to justify this award. Artem Kukin believes that the legalization of sham debts through arbitration really takes place in practice but it doesn’t mean that all the arbitration awards are void.

The deputies of the Russian State Duma offer to significantly broaden creditors’ rights. In particular a creditor will be entitled to commit an act of a debtor’s bankruptcy without a judgement on the debt recovery. Accordingly Artem Kukin this principle was already applied in the Russian Bankruptcy Act of 1998 but was no good for society.
