COMMENTARY BY KSENIA RIF ON PRAVO.RU

In January 2026, amendments to the Law "On Advertising" will come into force. The Federal Law was supplemented with a new Article 28.1, which regulates the advertising of bankruptcy services for individuals.

The norm prohibits promising a complete write-off of debts and calling for non-payment of obligations, and also obliges warning about the negative consequences of the procedure, including restrictions on obtaining loans and repeated bankruptcy.

According to Infralex Advisor Ksenia Rif, the mass distribution of advertising slogans like "we will write off debts without court and costs" not only distorts the essence of the legal procedure, but also causes real harm.

"On the one hand, such promises mislead the most vulnerable categories of debtors, encouraging them to take out new loans to pay for services. On the other hand, they form a false perception in society of bankruptcy as a simple and painless way to get out of debt," Ksenia explained.
